TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, July 30, 2012 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.


        Application of Uriah Corp., 41 New Road, East Greenbush, NY  12061 on behalf of Ejaz Ahmad current property owner, for an Area Variance that will allow for the applicant to pursue approval to construct a Duplex Dwelling at 24 Worden Road, Glenville, NY  12302.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 30.6-1-18.
        In accordance with the Codes of the Town of Glenville 270 Attachment 1, the minimum lot frontage for the construction of a two-family dwelling is 140 feet.  The lot at 24 Worden Road has frontage of 120 feet.  Therefore the applicant is seeking a lot frontage variance of 20 feet.


        Application of Judy C. Li, 3 Evergreen Blvd, Glenville, NY  12302 for an Area Variance that will allow for the construction of a new 16’ x 14’ carport attached to the dwelling a distance of 21 feet from the lot line of Lillian Drive.  The property is a corner lot and therefore has two front yards.   Said property is located in the Suburban Residential Zoning District and is identified on 22.10-4-22.
        In accordance with the Codes of the Town of Glenville 270 Attachment 1, the minimum front yard setback is 30 feet.  Therefore the applicant is seeking a front yard setback variance of 9 feet.


        Application of 312 Stage Rd., LLC, Fred Ogle,  PO Box 468 Burnt Hills, NY  12027, for a Conditional Use Permit that would allow for the establishment of the Creekside Café and Coffee House LLC at  658 Saratoga Road, Glenville, NY  12302 (formerly Jan’s Roadhouse).  Said property is located in the Community Business Zoning District and is identified on tax map 10.17-7-12.
        In accordance with the Codes of the Town of Glenville 270-18 (C): Restaurants, cafes and other eating establishments, excluding fast food restaurants are permitted by Conditional Use Permit and Site Plan Review.  The applicant has also applied to the PZC for a Site Plan Review.

        Application of RD Management LLC, 810 7th Avenue, 10th Floor, New York, NY  10019 for Two Area Variances for property located at 8-10 Glenridge Road, Glenville, NY  12302. (Retail Shopping Plaza/Pad Site as a result in a revised site plan.  The new plan proposes a drive-thru lane to be constructed 17 feet from the front lot line as well as the elimination of required shade trees along the road.  Said property is located in the General Business Zoning District as well as the Town Center Overlay District and is identified on tax map:  22.11-4-15.121
        In accordance with the Codes of the Town of Glenville 270-141 (B)(3):  Any property being developed for nonresidential purposes or multifamily development will maintain a minimum of 25 feet of green space between the street right of way and the parking lot.  Landscaping and/or curbing is required in order to prevent vehicle incursion.  Furthermore, no vehicles will be parked in this 25' green area.    The project calls for a drive-thru lane to be constructed 17' from the front lot line.  Therefore, the applicant is seeking a variance of 8 feet.  And, 270-141 (D)(2):  All landscape plans must include shade trees planted in a tree lawn located between 10 and 15 feet from the edge of pavement.  Trees shall be planted no more than 30 feet apart.    The project calls to eliminate these trees and replace them with "ornamental grasses".   Therefore, the applicant is seeking total relief from this section of the code.


        Application of Shady Lane Realty Inc. 123 Saratoga Road, Glenville, NY 12302 for Two Area Variances that will allow for the construction of a new 3-story (40 foot high) retail/office/apartment building at 113 Saratoga Road, Glenville, NY  12302  a distance of 15 feet from the side lot line.  Said property is located in the Community Business Zoning District and is identified on tax map: 22.18-1-5.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1: the maximum building height is 35 feet.  Therefore the applicant is seeking a building height variance of 5 feet. AND 270-Attachment 1: the minimum side setback is 20 feet.  Therefore the applicant is seeking a side setback variance of 5 feet.

        Application of W. S. Plaza, Inc., 123 Saratoga Road, Glenville, NY 12302 for an Area Variance that will allow for 7 additional parking spaces at the Socha Plaza Shopping Center, 123 Saratoga Road, Glenville, NY  12302 to be located 2 feet from the side lot line.  Said property is located in the Community Business Zoning District and is identified on tax map 22.15-2-51.
        In accordance with the Codes of the Town of Glenville 270-73 (C)(3):  All parking lots/areas associated with nonresidential uses and multifamily uses will be located no closer than 25 feet to any street right-of-way, nor closer than 10 feet to the rear or side property lines.  Therefore, the applicant is seeking a side lot line variance of 8 feet.


Request to Re-Hear/Modify Decision:

RD Management’s request to modify an approved variance regarding the reduction of required landscape islands on the Retail Shopping Mall/Pad Site located at 8-10 Glenridge Road.   The applicant is looking to farther reduce the required 19 landscape islands from the approved 11 to 9.
